Defects in Nespresso Vertuo

A new class action lawsuit has been filed against Nespresso USA Inc., accusing the company of selling Vertuo Next coffee machines that develop water leaks after normal use—allegedly rendering them unusable.

Lawsuit Filed in New York Federal Court by Florida Consumer

Plaintiff Denise Fahey-Ramirez, a consumer from Florida, brought the case in the U.S. District Court for the Southern District of New York, seeking to represent a nationwide class of consumers, as well as a Florida subclass. She claims that the machines, which Nespresso touts as the most versatile model in its Vertuo line, contain a design defect that causes water to leak internally, ultimately halting the brewing function.


Alleged Defect Makes Machines Unusable

According to the lawsuit, the defect compromises the machine’s ability to brew coffee, a failure that occurs even after what consumers consider normal use.

“Contrary to Nespresso’s representations, the Devices are designed and manufactured with an inherent defect that results in water leakage and compromises the ability of the machines to operate as intended,” the complaint alleges.

Fahey-Ramirez states that despite marketing the product as reliable and high-end, Nespresso failed to disclose the defect, which she says has been known to the company since the product launched in the U.S. in 2020.


Widespread Complaints Allegedly Ignored by Nespresso

The class action claims Nespresso has received numerous consumer complaints regarding water leakage and premature machine failure, often shortly after the one-year warranty period expires.

“Through records of (customer) interactions alone, Nespresso has been made aware of the pervasiveness of the Leakage Defect and their customers’ unhappiness,” the lawsuit states.

Despite this, Nespresso allegedly continued to sell the machines without issuing a recall, public warning, or offering customers appropriate compensation or replacements.


Fahey-Ramirez’s lawsuit includes multiple legal claims, including:

  • Unjust enrichment
  • Breach of express and implied warranties
  • Violation of the Magnuson-Moss Warranty Act
  • Violation of the Florida Deceptive and Unfair Trade Practices Act

She is demanding:

  • A jury trial
  • Monetary, statutory, and treble damages
  • Declaratory and injunctive relief for herself and all affected consumers

This isn’t the first time a major coffee company has faced legal scrutiny. In a related industry matter, the U.S. Securities and Exchange Commission fined Keurig Dr. Pepper $1.5 million for allegedly misleading consumers and regulators about the recyclability of its K-Cup pods.
